Wisconsin Statutes
Usually, the mere "calling in" of a delinquent employer, by the district attorney's office, for a conference regarding the delinquency, has had a salutary effect. Apart from this particular statutory provision, the trust agreements specifically permit the trustees, or their authorized representatives, to examine the payroll records of any participating employer whenever such examination is deemed necessary by the trustees. The right to so inspect the payroll records may be judicially enforced through an appropriate civil action commenced by the trustees.
Other methods for collecting delinquent accounts, employed by the various boards of trustees, are the commencement of civil actions for debt founded on the labor agreement or the filing of unfair labor practice charges with the Wisconsin Employment Relations Board, alleging violations of the labor agreement.
